• GBG hosts the Supplier Data
• No personal data is transferred to the Supplier

The Supplier Data used to provide Land Registry UK Companies that own Property in England and Wales data is provided by GBG’s Supplier, HM Land Registry (“Land Registry”). GBG is obliged under the terms of its agreement with Land Registry to ensure that all End Users agree to comply with the following licensing provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Permitted Purpose” means the purposes, restrictions and or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.3 – 2.5 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1

2. USE OF THIS DATASET
2.1 This Dataset may only be used for the Customer Use Cases detailed in this clause 2.1 , provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:
• Fraud
• Law Enforcement
• Debt Collection or Recovery
• Asset Reunification
• Evidence Gatherers (B2B/Private Sector)
• Affordability
• Media
2.2 In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the following terms set out in clauses 2.3-2.5 also apply
2.3 The Dataset must not be used for any of the following purposes:
(a) to use the Supplier Data for the purposes of direct marketing including but not limited to contacting registered proprietors to offer goods or services or to make other offers;
(b) for any purpose that is contrary to any law or regulation or any regulatory code.
2.4 The End User must not:
(a) use the Land Registry Title Number or permit it to be used in any way that causes the Land Registry’s systems or access to those to be interrupted, damaged or impaired in any way; and
(b) present out-of-date information as being current or in a manner that might mislead or use the Supplier Data in a way that suggests any official status or that Land Registry endorses the End User or the End User’s use.
2.5 The Supplier Data contains public sector information which is Crown Copyright. The End User acknowledges and accepts that responsibility for ensuring compliance with the terms of the Crown Copyright will lie solely with the End User.
2.6 The End User warrants that it will not use the Dataset for any reason outside the Customer Use Case and Permitted Purpose.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1 GBG provides this Dataset in its capacity as an independent controller.
3.2 GBG does not transfer End User Data to Land Registry to provide this Dataset. 

4. INTELLECTUAL PROPERTY RIGHTS
4.1 All proprietary rights in the Supplier Data are subject to Crown copyright and protection. The End User does not have the right to use or reproduce the registered trademarks and logos of Land Registry without Land Registry’s prior written permission. Any loss of revenue or costs (including legal costs) attributable to such infringement will be payable by the End User.

5. TERMINATION
5.1 Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with Land Registry, the supply of this Dataset may be terminated on 3 months’ notice.
5.2 Upon GBG’s notice, the End User will as soon as reasonably possible, but by no later than 48 hours delete or destroy all Supplier Data in relation to this Dataset that is in the End User’s possession, custody or control.
