• GBG hosts the Supplier Data
• No personal data is transferred to the Supplier

The Supplier Data used to provide CRA Business Data is supplied by GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licencing provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Credit Limit” means an advisory financial cap on the credit that should be extended to a company or other business entity in a given timeframe
“Credit Score/Risk Indicator” means an assessment of credit worthiness of a company or other business entity based on algorithmic analysis of available data (financial or otherwise)
“Credit Risk Bands” means an assessment of the creditworthiness of a company or other business entity by linking or referring to the company or business entity in connection with a specific credit risk/score category or band
“Permitted Purpose” means the purposes, restrictions and or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.2 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1.

2. USE OF THIS DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:
• Fraud
• Law Enforcement
• Debt Collection or Recovery
• Asset Reunification
• Evidence Gatherers (B2B/Private Sector)
• Affordability
• Media
2.2. The End User must not
(a) sell, transfer, or distribute any part of the Supplier Data to any third party;
(b) extract, modify, adapt, reutilise, use, exploit, redistribute, copy or store the Supplier Data for any purpose not expressly permitted by the General Terms and/or these Additional Terms;
(c) produce a credit report or any product or service (in any form whatsoever) containing or referring to the Supplier Data (on its own or in combination with other data) or any results, output or materials derived from the Supplier Data which bears upon, refers to or otherwise relates to the creditworthiness of any given business or trading entity and/or produce a Credit Score/Risk Indicator or Credit Limit or Credit Risk Bands; and
(d) Use any Supplier Data which relates to non-limited entities or sole traders to:
i. Compile a list of prospective businesses for the purpose of conducting telesales, telemarketing or direct email campaigns which are aimed at a target market and otherwise fall within a specific category/criterion; and/or
ii. Build a telephone director and/or business directory
2.3. The End User warrants that it will not use the Dataset for any reason outside of the Customer Use Case and Permitted Purpose.

3. INDEMNIFICATION
3.1. The End User agrees to indemnity, defend and hold GBG harmless from any and all actions judgements, proceedings, liabilities, losses (whether direct, indirect or consequential), cost, expenses, damages, claims or demands (including without limitation court costs and reasonable legal fees), made by any third party or incurred or suffered by GBG arising out of or in connection with the wilful misconduct or grossly negligent use of the Supplier Data.
3.2. Notwithstanding the liability provisions between GBG and the End User in the Agreement, the End User’s total aggregate liability in respect of liability under the indemnity in clause 3.1 above shall not exceed £7,500,000 in any year.

4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1. GBG provides this element of this Dataset in its capacity as an independent controller.
4.2. GBG does not transfer End User Data to the Supplier to provide this Dataset. 

5. MISCELLEANEOUS
5.1. The End User acknowledges and accepts that as part of the CRA Business Data Dataset, the End User will be directed to the following web page: www.192.com (“the Webpage”).
5.2. By entering and using the services on the webpage as outlined in clause 5.1 above, the Parties agree that:
(a) This part of the service will be provided by HooYu Ltd who will process the End User Data for the purposes of delivering this service to the End User;
(b) The End User will be subject to the Webpage terms and conditions in relation to its use of this Dataset; and
(c) GBG excludes all liability with the End User in relation to the use and access of the Webpage.
