The Supplier Data used to provide the Land Registry Price Paid Dataset is provided by GBG’s Data Supplier, HM Land Registry (“Land Registry”). GBG is obliged under the terms of its agreement with Land Registry to ensure that all End Users agree to comply with the following licensing provisions:
1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Permitted Purpose” means the purposes, restrictions and or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.3 – 2.5 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1
2. USE OF SUPPLIER DATA
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement:
2.3 The Supplier Data contains public sector information which is Crown Copyright and licensed under the Open Government Licence v3.0 (http://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/) which is incorporated into these Additional Terms. The End User acknowledges and accepts that responsibility for ensuring compliance with the terms of the Crown Copyright, including obtaining any necessary licenses, will lie solely with the End User.
2.4 The End User shall not edit, alter or amend the Supplier Data. Where an End User is explicitly permitted in its Agreement with GBG to publish or otherwise share the Results with any other third party (for example as an authorised reseller or channel partner), the End User must ensure that all additional End Users who receive or access the Results receive a copy of these Additional Terms and associated copyright notices and licences.
2.5 The End User agrees to not to use this Dataset in a way that suggests any official status or in a way that suggests that Land Registry endorses the End User or its use of the Supplier Data.
2.6 The End User warrants that it will not use this Dataset for any reason outside the Customer Use Case and Permitted Purpose.
3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1 The Supplier Data used to provide you with this Dataset is hosted by Land Registry in the United Kingdom. In order to perform the Services, Land Registry shall receive and process End User Data in its capacity as an independent controller for the sole purpose of delivering this Dataset.
4. INTELLECTUAL PROPERTY RIGHTS
4.1 All proprietary rights in the Supplier Data are subject to Crown copyright and protection. The End User does not have the right to use or reproduce the registered trademarks and logos of Land Registry without Land Registry’s prior written permission. Any loss of revenue or costs (including legal costs) attributable to such infringement will be payable by the End User.
5. MATCHING RULE
5.1. This Dataset will be processed against the Standard Matching Rule of address only.
