The Supplier Data used to provide the International Address Cleansing Dataset is supplied by a number of GBG’s Suppliers. GBG is obliged under the terms of its agreement with its Supplier (Supplier 5) to ensure that all End Users agree to comply with the licensing provisions set out below. Supplier 5 provides GBG with French address data.

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.

2. USE OF THE DATASET
2.1 This Dataset may only be used for the Customer Use Case detailed in this clause 2.1, provided that such Customer Use Case is selected on the End User’s Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:

2.2 The End User warrants that it will not use this Dataset for any reason outside of the Customer Use Case.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1 GBG provides this Dataset in its capacity as an independent controller.
3.2 GBG does not transfer End User Data to the Supplier to provide this Dataset.

4. INTELLECTUAL PROPERTY RIGHTS
4.1. The End User acknowledges that the Supplier Data constitutes an original work and that the Supplier and or its third party providers maintain in this respect the ownership of the Supplier Data as its author in accordance with article L111-1 of the Intellectual Property Code. Consequently, any infringement of these rights as set out above constitutes a criminal offence of counterfeiting with sanctions under article L335-2 of the Intellectual Property Code.
4.2. Moreover the data relating to the geographical references contained in the Supplier Data are protected by Law no. 98-536 of 1 July 1998 relating to databases and modified by Law no. 2007-1544 of 29 October 2007.
4.3. As the producer of the information contained in the Supplier Data, the Supplier and its third party providers alone hold, pursuant to article L 324-1 of the Intellectual Property Code, rights to extract and reuse the totality or a part of the data contained in the Supplier Data.
4.4. Any infringement of one of these rights by the End User is penalised by article L 343-1 of the Intellectual Property Code. Consequently, the use of the Supplier Data is authorised only according to the conditions set out in this Additional Terms.
4.5. It is properly understood that these Additional Terms do not transfer to the End User any property right to the Supplier Data which remains the exclusive property of the Supplier or its third party provider.

5. TERMINATION
5.1. Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with its Supplier this Dataset can be terminated upon the Supplier providing GBG with two (2) months’ notice.

6. MATCHING RULE
6.1. This Dataset will be processed against the Standard Matching Rule of address only.
