The Supplier Data used to provide Australia Geo S59 Dataset is obtained from GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all Clients agree to comply with the following provisions:
1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Permitted Purpose” means use of the Supplier Data for address verification cleansing and validation.
2. USE OF THE DATASET
2.1. This Supplier Data may only be used for the Permitted Purpose in accordance with these terms.
2.2. The Client shall not use the Supplier Data for the generation of an address or a compilation of addresses for the sending of mail unless the Client has verified that each address to be used for the sending of mail is capable of receiving mail by reference to a secondary source of information other than the Supplier Data.
2.3. The Client acknowledges and accepts the Supplier Data is subject to some open source licences. The Client must comply with those open source licences mentioned here (as amended from time to time): https://geoscape.com.au/legal/data-copyright-and-disclaimer/.
3. EXCLUSION OF WARRANTIES AND LIABILITY
3.1. The Supplier Data are provided on an “as is” and “as-available” basis. No statement, representation, or warranty of any kind (whether express, implied, statutory or other) is given in relation to the Supplier Data (including without limitation any warranties of title, merchantability, fitness for a particular purpose, non-infringement, absence of latent or other defects, accuracy, or the presence or absence of errors, whether or not known or discoverable).
3.2. In no event will GBG and the Data Supplier be liable to the Client on any legal theory (including, without limitation, negligence) or otherwise for any direct, special, indirect, incidental, consequential, punitive, exemplary, or other losses, costs, expenses, or damages arising out of the use of the Supplier Data and/or Dataset, even if the Client has been advised of the possibility of such losses, costs, expenses, or damages.
4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1. GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted by GBG.
