• Supplier hosts the Supplier Data
• Supplier is a Sub-processor of Client Information
• Client Information includes Personal Data
• The Sub-processor is based in Norway
• The Sub-processor is located within the EEA
• The End User must NOT provide Personal Data belonging to EEA Data Subjects for Sub-processing by this Data Supplier
• The Sub-processor may not be able to demonstrate sufficient guarantees and appropriate technical and organisational measures to meet the requirements of GDPR

The Supplier Data that GBG uses to provide Mobile Validation is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all End Users agree to comply with the provisions set out below. These terms apply to all Mobile Validation checks. Individual Mobile Validation checks are identified by an ID Number on the End User’s Order Form.

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Permitted Purpose” means for obtaining location data and statuses of mobile phone numbers to be used by the End User for its own internal use.

2. USE OF THE SERVICE
2.1. The End User may only use Mobile Validation for the Permitted Purpose in accordance with the terms contained within these terms.

3. END USER OBLIGATIONS
3.1. The End User agrees to notify GBG as soon as possible of any defects it discovers in relation to the Supplier Data.

4. LIABILITY
4.1. Notwithstanding the liability of GBG to the End User as set out in the General Terms, due to restrictions within GBG’s agreement with the Data Supplier, in relation to Mobile Validation, GBG shall only be responsible for direct loss or damage caused to the End User unless such loss is caused by gross or premeditated negligence of GBG or its Data Supplier.

5. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
5.1. The End User warrants that it shall not provide Personal Data belonging to EEA Data Subjects for sub-processing by this Data Supplier.
5.2. The End User acknowledges and accepts that the Data Supplier as Sub-processor may not be able to demonstrate sufficient guarantees and appropriate technical and organisational measures which fully meet the requirements of GDPR

6. TERMINATION
6.1. Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with its Data Supplier, the supply of Mobile Validation can be terminated on one month’s notice if the Data Supplier is unreasonably burdened where an Event of Force Majeure occurs.

7. GOVERNING LAW AND JURISDICTION
7.1. In relation to any matter concerning Mobile Validation and these terms and conditions, these terms and conditions shall be exclusively governed by the laws of Norway and the Client agrees to submit to the Norwegian courts by Moss Tingrett as the legal venue.
