• The Supplier hosts the Supplier Data
• The Supplier is a processor of End User Data appointed by GBG in its capacity as an independent controller
• The Supplier is located in the United States of America
• The Supplier is located outside of the EEA
• The Supplier uses further third party processors based in the United States
• GBG has an arrangement in place with the Supplier to maintain appropriate safeguards

The Supplier Data that GBG uses to provide Email Validation V2 is supplied by GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licensing provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“C2P Model Clauses" means the model clauses for the transfer of personal data to processors established in third countries approved by the European Commission, the approved version, of which, in force at present is that set out in the European Commission's Decision 2010/87/EU of 5 February 2010 (available at https://eur-lex.europa.eu/legal-content/en/TXT/?uri=CELEX%3A32010D0087), as such model clauses may be amended or superseded by the European Commission from time to time. Where the transfer is from the United Kingdom, the relevant model clauses are those approved by the European Commission or in the alternative, standard data protection clauses specified by regulations by the Secretary of State or standard data protection clauses specified in a document issued (and not withdrawn) by the UK Information Commissioner
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Permitted Purpose” means the purposes, restrictions and/or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.2 – 2.3 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1.

2. USE OF THIS DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement and these Additional Terms:
• Fraud
• Law Enforcement
• Debt Collection or Recovery
• Asset Reunification
• Evidence Gatherers (B2B/Private Sector)
• Affordability.
• Media
2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the End User must not under any circumstances use this Dataset for the purpose of:
• Transmitting or posting chain letters or pyramid schemes or other acts that involve deceptive online marketing practices or fraud;
• Acts that may materially and adversely affect the quality of experience of other users of the Supplier Data;
• Actual or attempted unauthorised use or sabotage of any computers, machines or networks;
• Introducing malicious programs into the Supplier Data or the Supplier’s network or servers;
• Engaging in any monitoring or interception of data not intended for the End User without authorisation;
• Using any method, software or program designed to collect identity information authentication credentials, or other information;
• Transmitting or receiving, uploading, using or reusing material that is abusive, indecent, defamatory, harassing, obscene or menacing, or a breach of confidence, privacy or similar third party rights.
2.3. The End User warrants that it will not use the Dataset for any reason outside of the Customer Use Case and Permitted Purpose.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1.The Supplier Data used to provide you with this Dataset is hosted by the Supplier in the United States. In order to deliver this Dataset, the Supplier shall receive and process End User Data in its capacity as a processor.
3.2. GBG has entered into C2P Model Clauses with the Supplier to ensure safe onward transit of End User Data.
