• The Third-Party Provider hosts the Supplier Data
• The Third-Party Provider is a Sub-processor of the Client Information
• The Sub-processor is located in the United States

These terms shall apply to End Users of the Canadian NCOA Data (the “Supplier Data”). The Supplier Data is provided to GBG by GBG’s Third Party Provider and includes data from Canada Post (the “Data Supplier”). Consequently, these terms acknowledge the rights of both the Third-Party Provider and the Data Supplier.

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Business Relationship” shall mean a relationship between a mover and an organization when an individual or business has: (i) made a purchase or donation, rented, leased, contracted, or participated in an organization’s provision of products or services within the past 24 months; or (ii) requested information or made an inquiry within the last 6 months. If such purchase, donation, rent, lease or contract for the provisions of products and services involves ongoing use or transactions under a subscription, account, loan or similar relationship, the 24-month period starts on the day the relationship terminates.
“Client Information” means all data and any other materials provided or otherwise made available to GBG by or on behalf of the End User.
“Third Party Provider” means the supplier who is contracted with GBG to provide the Supplier Data.

2. USE OF THE SERVICE AND END USER RESPONSIBILITIES
2.1. Use of the Supplier Data is subject to the following conditions of use:
(a) It must only be used to update a database record with new mover information if a Business Relationship exists between the recipient organization and the mover.
(b) Where there is no Business Relationship, the End User may only use the Supplier Data to update a customer or third-party mailing list for the sole purpose of mailing.
(c) A third-party mailing list cannot be cleansed with the Supplier Data before being rented. A third-party mailing list can only be updated with the Supplier Data for the purpose of mail.
2.2. The End User must not use the Supplier Data to:
(a) Augment an address database to include any person with whom the End User does not have a business relationship;
(b) Create a mailing list or other sub-list to target customers based on the knowledge of their move;
(c) Use the Supplier Data to find specific individuals by carrying out a single instance data retrieval, skip tracing or verifying address information for a single address;
(d) Conduct any statistical activities or analyse mover patterns;
(e) Sell commercial lists or license a data file that include Supplier Data updates.
(f) For any other purposes other than correcting mailing lists or updating databases where a business relationship exists.
2.3 The End User will ensure that any additional recipients of the Supplier Data are aware that they are also subject to these Additional Terms.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1. The Supplier Data used to provide this element of the Service is hosted by the Third-Party Provider. In order to perform the Services, the Third-Party Provider shall act as Sub-processor of Client Information (including any Personal Data supplied) for the sole purpose of delivering this element of the Service. The End User authorizes GBG to appoint the Third-Party Provider as Sub-Processor for the purposes specified in this clause 3.
3.2. The Third-Party Provider is based in the United States.
