Section 9: New Zealand Transport Authority (NZTA)

1. Overview

1.1 This clause applies where Consumer Risk Services, including information obtained from the NEW ZEALAND TRANSPORT AGENCY (Waka Kotahi NZ Transport Agency) a Crown entity, established on 1 August 2008 by section 93 of the Land Transport Management Act 2003 (“NZTA” or “Waka Kotahi”), is accessed.

1.2 You understand that we have been provided with the NZTA Information which forms part of the Services and neither We nor NZTA are responsible for how you use the NZTA Information and/or your conduct or actions in relation to NZTA information.

1.3 You understand and agree that NZTA’s provision of the NZTA Information to Us is mere confirmation that a record of an individual’s driver’s licence exists at the date of an enquiry, that the authenticated licence of an individual has been genuinely issued and that the license is not recorded by NZTA as cancelled, lost or stolen as at the date of enquiry.

1.4 We and NZTA do not accept any liability whatsoever, now or in the future, in respect of any reliance that you place on the accuracy of the NZTA Information, irrespective of how and what the purpose of the NZTA Information is used for by You.

1.5 For the purpose of this Section 9, NZTA Information refers to reports that contain information obtained from the New Zealand Drivers Licence Register.

1.6 You must obtain the express consent of the individual named on the Photo Drivers License (PDL) prior to submitting a request via the NZTA service.

1.7 GB Group Plc and/or any of its subsidiaries (together, the “Licensee”) act independently from (and not on behalf of) Waka Kotahi in regard to Driver Licence information. As a result, the Licensee (not Waka Kotahi) is responsible for the Licensee’s conduct and actions in regard to Driver Licence information.

Waka Kotahi does not guarantee that there is a confirmation of the identity of the individual holding or using the driver licence. Information provided by Waka Kotahi to the Licensee merely confirms that a record of a current PDL exists at the time of the inquiry, and that any authenticated PDL card has been genuinely issued and is not recorded as cancelled, or lost, or stolen as at the date of enquiry.

Waka Kotahi does not accept any liability in respect of the accuracy of the Driver Licence information.
