Section 1: Document Verification Service Terms

  1. Definitions and interpretation

    1.1 “Agreement” means your agreement with us under which we provide you identity verification services.

    1.2 “DVS” has the meaning given to the term ‘DVS’ in section 15 of the IVS Act.

    1.3 “Information Match Agent” means a person appointed as an agent to act for You and on Your behalf solely for the purposes of your use of the DVS, including the:
    1. making of an Information Match Request; and
    2. receiving of an Information Match Result.

    1.4 “Information Match Request” means an electronic request to the DVS by You (required to be submitted in a structure electronic format advised by the Framework Administrator) to be provided with an Information Match Result in relation to the details of relevant information in a Supported Document.
  • 1.5 “Information Match Result” means, in respect to an Information Match Request, an electronic response indicating that the information provided in the request either matches or does not match the relevant official record data, or that a system error has been encountered in trying to process that request.

    1.6 “IVS Act” means the Identity Verification Services Act 2023 (Cth).

  • 1.7 “Framework Administrator” means the Commonwealth of Australia acting and represented by the Attorney-General’s Department and, also includes, in respect of each type of document supported by the DVS, the applicable entity whose official record data is matched against that document and (in the case of Australian State and Territory), Austroads Ltd and the relevant Registry of Births, Deaths and Marriages (BDMs).

    1.8 “Participation Agreement” means the agreement entered into by You and the Commonwealth of Australia, relating to the your access to and use of the DVS.

  • 1.9 “Supported Document” means a type of document set out in the definition of ‘DVS document’ in section 5 of the IVS Act.

  1. Application

    2.1 By subscribing to the DVS, you agree to and comply with the DVS Business User Participation Agreement, the DVS Identity Services Provider Participation Agreement, and any terms as may be specified by the Framework Administrator (“DVS Terms”) as applicable to you. The DVS Terms are set by the Framework Administrator. The DVS Terms can be provided to you upon your written request, subject to any restrictions and requirements as may be imposed by the Framework Administrator.   2. Appointment as an Information Match Agent

    3.1 You appoint GBG ANZ Pty Ltd as an Information Match Agent.

    3.2 You may revoke our appointment as an Information Match Agent at any time.

    3.3 Any appointment of us as an Information Match Agent will be automatically revoked at the expiration or termination of the Agreement.

  3. Use of the DVS

    4.1 You agree that all disclaimers, exclusions, limitations of liability and indemnities that form part of the Agreement are for our benefit and for the benefit of the Framework Administrator, and can be enforced by us on behalf of the Framework Administrator or directly by the Framework Administrator.

  4. Identity Service Provider

    5.1 This clause 5 only applies if you are an Identity Service Provider (IDSP) of the DVS. Unless otherwise expressly provided, defined terms used in this clause 5 have the same meaning as those terms are defined under the IDSP Participation Agreement with DVS.

    5.2 You will:

    5.2.1 provide details of all your DVS Service Clients (this applies to any new DVS Service Client);

    5.2.2 ensure all DVS Service Clients meets the usage requirements of the DVS and provide relevant information to evidence the manner in which you concluded the DVS Service Client meets such usage requirements prior to allowing the DVS Service Client to submit any transactions;


    5.2.3 ensure all DVS Service Clients will comply with these Additional Terms and your IDSP Participation Agreement as applicable;

    5.2.4 maintain appropriate records of all DVS Service Clients including records of transactions created and submitted and IP addresses and submit monthly reports to us outlining these details;

    5.2.5 upon our request, within 1 business day (or such other reasonable time as we may specify), provide us with the requested information in relation to your DVS Service Clients and the use of the Services;

    5.2.6provide us with reasonable assistance and information we may require for us to meet our regulatory obligations; and

    5.2.7 provide support and maintenance services to your DVS Service Clients.

    5.3  Audits. You understand that we are required by the Framework Administrator to conduct audits on the ID Service Providers. As such, you agree that we are entitled to conduct an on-site and/or inspection or to appoint a third-party auditor, subject to us and/or our third-party auditor’s agreement to reasonable and appropriate confidentiality undertakings. The purpose of our right to carry out an audit and/or inspection is to verify your compliance with the DVS requirements, including but not limited to: onboarding and validation, recording of consent prior to submission of document for verification, disclosure of Match Results.
