The Supplier Data that GBG uses to provide USA Consumer Insight & Segmentation Data is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with GBG’s Data Supplier to ensure that all End Users agree to comply with the following provisions set out below. These terms apply to all USA Consumer Insight & Segmentation Data checks. Individual USA Consumer Insight & Segmentation Data checks are identified by the ID Number on the End User’s Order Form.: 

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
Derived Materials” means any analyses, works, reports, data or other materials which to any extent are derived from or incorporate any of the Output Material.
Prohibited Material” means any use described as such in these Additional Terms.
Prohibited Uses” means any use described as such in these Additional Terms.

2. USE OF THE SERVICE
2.1. The following are Prohibited Uses: any use (i) for product or model development; (ii) for political campaigning (including activity in support of, or against, a political party, a referendum campaign or a candidate standing for election); or (iii) in connection with any Prohibited Material.
2.2. The following are Prohibited Materials: anything pornographic, obscene, offensive, racist, abusive, harassing, bigoted, violent, criminal, discriminatory, libellous, defamatory, unlawful or illegal; anything which promotes any services relating to (i) road traffic accident or personal injury claims; (ii) medical or clinical negligence claims; or (iii) the missale of financial products (including the reclaim of PPI premiums or compensation for missale of PPI products); anything which fails to comply with any applicable guidance or code of practice, including the Information Commissioner’s Office’s Guidance on Direct Marketing, the Direct Marketing Association’s Code of Practice and the Advertising Standards Agency’s UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing; and (except as otherwise expressly permitted in this Service Schedule) anything related to tobacco, alcohol or pharmaceuticals associated with sexual performance.

3. END USER OBLIGATIONS
3.1. The End User must:
(a) Not use the Output Material in connection with any Prohibited Material nor for any Prohibited Uses.
(b) promptly notify GBG of any breach of these Additional Terms.

4. QUESTIONNAIRES
4.1. Data Supplier may from time to time request GBG to complete a questionnaire relating to GBG and/or the End User’s manner of complying with this Agreement including these Additional Terms (“Questionnaire”). Where requested, the End User shall provide its cooperation with such request within the timescales indicated in the request.

5. CONFIDENTIALITY
5.1. Notwithstanding any confidentiality obligations to the contrary, GBG shall be permitted to inform the Data Supplier if:
(a) of any opinions communicated by End Users or other information of which GBG becomes aware which are likely to be relevant to the perceived value of the Output Material;
(b) any dispute arises between GBG and any of the End Users in respect of the Output Material; and/or
(c) the End User has breached or is likely to breach these Additional Terms or any term of the General Terms which has the potential to have a detrimental impact on the Data Supplier.

6. TERMINATION
6.1. Upon termination or expiry of this Agreement the End User shall:
(a) promptly destroy, delete the Output Material and any relevant Derived Materials (and all copies thereof) which remain in the possession or control of the End User; and
(b) if requested, provide GBG and/or its Data Supplier with written confirmation, signed by a duly authorised person, that this clause has been complied with.
6.2. Each Party acknowledges that the other may have a standard data archiving policy which includes the creation and retention of backup copies of data and other information (“Retained Data”) held on archive computer systems for legal, regulatory, compliance, IT restoration and disaster recovery purposes (“Retention Purposes”). The above clause 6.1 shall not apply to Retained Data held on such archive computer systems but such Retained Data may only be used for the Retention Purposes.


7. DATA PROTECTION
7.1. GBG does not use Sub-processors to provide you with this element of the Service as the Supplier Data is hosted by GBG.
