• GBG hosts the Supplier Data
• No Sub-processors are used

The Supplier Data that GBG uses to provide this element of the Service is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all End Users agree to comply with the following provisions:

1. USE OF THE SERVICE
1.1 Where any portion of the Supplier Data is made available to an End User, the following provisions shall apply:
(a) the End User must not use the Supplier Data with geographic data from competitors of the Data Supplier;
(b) the End User acknowledges and accepts that the Supplier Data is subject to certain regulatory and third-party supplier restrictions and obligations (including copyright notices) which are currently available via the Data Supplier’s website at https://legal.here.com/en-gb/terms/general-content-supplier-terms-and-notices;
(c) where the End User is a United States Government user (and/or a similar body who wishes to claim similar rights), the Supplier Data shall be treated as a "commercial item", as defined at 48 C.F.R. 2.101, and is licensed in accordance with the End User terms specified in the Agreement and in these Additional Terms.
1.2 Where the End User is a reseller of GBG’s Service, the reseller shall ensure that its customer (also an End User) is subject to these Additional Terms and the reseller shall include a link to the regulatory and third-party supplier restrictions and obligations referenced at clause 1.1 (b) above within its contract with its customer.

2. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
2.1 GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted by GBG.

3. EXCLUSION OF WARRANTIES
3.1 The End User acknowledges and agrees that the Supplier Data is provided “as is” and, to the extent permitted by law, the Data Supplier disclaims all warranties, express implied or otherwise, of quality, performance, merchantability, fitness for a particular purpose and non-infringement.
3.2 Liability for any claim, demand or action arising out of the use or possession of the Supplier Data is expressly excluded irrespective of the nature of the cause of the claim, demand or action.
3.3 In no circumstance shall GBG or the Data Supplier be liable for any loss of profit, revenue, contracts or savings, or any other direct, indirect, incidental, special or consequential damages arising out of the use of, or inability to use the Supplier Data, any defect or inaccuracy in the Supplier Data, whether in an action in contract or tort or based on a warranty, even if the End User, GBG, the Data Supplier or their affiliates or suppliers have been advised of the possibility of such damages.
