• GBG hosts the Supplier Data
• No Sub-processors used

The data that GBG uses to provide Care Facility (Scotland and Wales) is obtained from the Care Inspectorate (“Data Supplier”) who has published the Supplier Data in accordance with its open source licence terms under the Open Government Licence v3.0. GBG is obliged under the terms of the open source licence provided by its Data Supplier to ensure that all End Users agree to comply with the following provisions:

1. USE OF THE SERVICE AND COPYRIGHT LICENCES

1.1 The Supplier Data contains the statutory addresses and supplementary information for care homes in Scotland and Wales, National Statistics data © Crown copyright and database and is licensed under the Open Government Licence v3.0 which is incorporated into these Additional Terms. In the event of a breach of these Additional Terms by an End User, the rights granted to the End User under this licence or any similar licence will end automatically.

1.2 The Supplier Data is taken from the Data Supplier and includes information on care home properties in Scotland and Wales, with a range of details captured on each property.

1.3 Where an End User is explicitly permitted in its Agreement with GBG to publish or otherwise share the Supplier Data with any other third party (for example as an authorised reseller or channel partner), the End User must ensure that all additional End Users who receive or access the Supplier Data receive a copy of these Additional Terms and associated copyright notices.

2. END USER OBLIGATIONS

2.1 The End User agrees to not to use the Supplier Data in a way that suggests any official status or in a way that suggests that the Data Supplier endorses the End User or its use of the Supplier Data.

3. EXCLUSION OF WARRANTIES

3.1 The End User acknowledges and accepts that the records contained within the Supplier Data are submitted by providers. Due to the nature of the collection of the Supplier Data, some information may be out of date and of varying quantity and quality.

3.2 The Supplier Data is licensed 'as is' and the Data Supplier and GBG exclude all representations, warranties, obligations and liabilities in relation to the Supplier Data to the maximum extent permitted by law.

3.3 The Data Supplier and GBG are not liable for any errors or omissions in the Supplier Data and shall not be liable for any loss, injury or damage of any kind caused by its use.

3.4 The Data Supplier and GBG cannot guarantee the continued supply of the Supplier Data.

4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS

4.1 GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted by GBG.
