The Supplier Data that GBG uses to provide National Deceased Register, Goneaways and Re-mover data is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all End Users agree to comply with the provisions set out below. These terms apply to all National Deceased Register, Goneaways and Re-mover data checks. Individual National Deceased Register, Goneaways and Re-mover data checks can be identified by the ID number on the Order Form. 

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Match” means an individual name and address from the End User’s database, which is matched (either wholly or in part) against the Supplier Data;
“One Use Suppression” means a record, which is removed from the End User’s database to identify a Match after the End User’s database, has been run against the Supplier Data in accordance with these terms and the Agreement;
“Permanent Flag” means a flag, which is appended to a data record in the End User’s database to identify a Match when the End User’s data is screened against the Supplier Data in accordance with these terms and the Agreement. The Permanent Flag must not contain any Supplier Data trademarks or actual data from within the Supplier Data;
“Permitted Purpose” means use of the Supplier Data solely for the purpose of suppressing and/or flagging records contained within the End User’s database, including any and all Permanent Flags and information relating to data records which have been suppressed One Use Suppression, for the purpose identifying deceased individuals.
“Supplier Data” means a database of personal information of deceased individuals supplied by the Data Supplier, and any and all information derived from it including any and all Permanent Flags and information relating to data records which have been suppressed from an End User’s database using One Use Suppression.

2. USE OF THE SUPPLIER DATA
2.1 The Supplier Data may only be used for the Permitted Purpose in accordance with these terms.
2.2 The End User shall not:
(a) copy, reformat, adjust, amend, subtract, or in any way alter or change, adapt, vary or modify the Supplier Data (or any part thereof);
(b) combine or merge the Supplier Data with any other data or list or do anything, which could prevent or hinder the identification of and/or affect the Intellectual Property Rights in the Supplier Data;
(c) use the Supplier Data for any reason outside of the Permitted Purpose;
(d) use the Supplier Data for the purpose of or in connection with the management of annuities or pensions schemes.
2.3 The End User must not create any database of deceased individuals comprising any Supplier Data.
2.4 The End User must not permit any third party to use or have access to the Supplier Data.
2.5 The End User must inform GBG immediately if it becomes aware, or has reason to believe, that the End User is not complying with these terms and the General Terms.
2.6 The End User shall ensure compliance with all relevant laws, regulations, codes of practice and guidelines in force from time to time, including without limitation compliance with data protection laws.
2.7 The End User acknowledges that the Supplier Data may contain seeded data to detect unauthorised use and such seeds may not be removed from the Supplier Data.
2.8 The End User shall not make any representation regarding the Supplier Data.
2.9 The End User shall not sub-licence, assign, transfer, sell, lease, rent, charge or otherwise deal in or encumber the Supplier Data, or make available, the Supplier Data to any third party except as provided for in these terms.
2.10 The End User shall for at least 6 years keep proper records (including all supporting documentation) relating to use of the Supplier Data.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1 GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted by GBG.

4. TERMINATION
4.1 Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with the Data Supplier, the supply of the Supplier Data may be terminated on 3 months’ notice.
4.2 In the event of termination of the supply of the Supplier Data, the End User must, at GBG’s option, return or destroy the Supplier Data without undue delay.
