The Supplier Data used to provide the Verify DQS - Goneaways Datasets is provided by GBG’s Suppliers, including Royal Mail’s National Change of Address (NCOA) Suppress dataset. GBG is obliged under the terms of its agreement with its Suppliers to ensure that all End Users agree to comply with the following licensing provisions:

  1. DEFINITIONS
    1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:

Customer Database” an electronic compilation of Customer Records;
Customer Record” the name and address of a current or lapsed customer or prospective customer of the End User which have been lawfully and fairly obtained by the End User solely for the purposes of marketing, commercial communications or customer administration;
End User Data” any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
NCOA ® Suppress Database” a database containing Suppression Data selected, arranged and compiled by Royal Mail using and stored on electronic media and including any updates to it;
Old Address” the address specified by a Redirection Customer as that from which mail should be redirected, as subsequently amended by Royal Mail, if necessary, to ensure that the address information is correct for Royal Mail’s postal purposes;
Permitted Purpose” means the purposes, restrictions and/or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.3 – 2.7 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1.
Processing” Batch Processing and/or Individual Look Ups in accordance with the Agreement.
Public Body” any department, office or agency of Her Majesty’s Government or any local government authority or agency or any other public authority.
Redirection Customer” a customer of the Redirection Service whose post is, at the relevant time, being redirected by Royal Mail from the relevant Old Address to the relevant new address pursuant to such service;
Redirection Form” the application form for individuals who wish to use the Redirection Service;
Redirection Service” the Supplier’s service for the redirection of mail provided to members of the public who have requested such service whereby mail which has been addressed to their Old Address is redirected to and delivered at their new address.
Royal Mail” means Royal Mail Group Limited, a company registered in England and Wales under registered number 04138203 whose registered office if at 100 Victoria Embankment, London EC4Y 0HW.
Suppression Data” address data held by Royal Mail on the NCOA® Suppress Database and updated on a periodic basis which is derived from Old Address information provided by Redirection Customers on the Redirection Form.

 

  1. USE OF THE DATASET
    2.1. This Dataset may only be used for a Customer Use Cases detailed below, and provided the End User complies with any use case restrictions set out in the Agreement:
    • Customer Management (Appending)
    • Customer Management (Data Quality)
    • Customer Management (Indicators)
    • Records Management (Appending)
    • Records Management (Data Quality)
    2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 the following terms set out in clauses 2.3 – 2.5 also apply
    2.3. The End User shall not use this Dataset for:
    (a) the purpose of assessing creditworthiness (other than for the analysis or pre-screening of its prospects or customers);
    (b) for sub-licensing, selling or otherwise disclosing or making available the Supplier Data to any third party acting as a credit reference agency or as a supplier of information use for assessing creditworthiness (other than for the analysis or pre-screening of its prospects of customers); and/or
    (c) sending any direct marketing to individuals.
    2.4. The End User acknowledges and accepts that any information derived from the Supplier Data is not intended to be used as the sole basis for any business decision and is based upon data which is provided by third parties, the accuracy and/or completeness of which it would not be possible and/or economically viable for the Supplier or GBG to guarantee.
    2.5. The End User shall not sell, transfer, sub-licence, distribute, commercially exploit or otherwise make available to, or use for the benefit of, any third party any of the Supplier Data.
    2.6. The End User warrants that it will not use the Supplier Data for any reason outside of the Customer Use Case and Permitted Purpose.
    2.7 Public Bodies, debt collection agencies or credit referencing agencies are not permitted to use the Suppression Data provided under this Dataset.

 

  1. MATCHING RULE
    3.1. This Dataset will be processed against the Default Matching Rule of Forename, Surname and Address. If required certain Variable Matching Rules may be requested by the End User in accordance with the Agreement.

 

  1. SUPPRESSION DATA

4.1 In relation to the Suppression Data, The End User warrants and undertakes to ensure that any Customer Database (in respect of which Processing is being performed) is owned or licensed by the End User for the End User’s own use and comprises only Customer Records used for the purposes of marketing, commercial communications and routine administration. In each case, the address in each Customer Record will be complete to the best of the End User’s knowledge prior to Processing.
4.2 The End User acknowledges that Royal Mail does not warrant:
(a) The accuracy and/or completeness of the Suppression Data;
(b) That the NCOA ® Suppress Database contains the names and addresses of all Redirection Customers; not
(c) That the NCOA ® Suppress Database does not infringe the Intellectual Property Rights of any third party.
4.3 The End User agrees that Royal Mail will not be liable for any loss or damage (whether direct or indirect) however arising from the use by the End User of Suppression Data, with the exception of death or personal injury caused by Royal Mail’s negligence.
4.4 The End User acknowledges that Royal Mail will not be liable to the End User in respect of its use of the Product.
4.5 The End User acknowledges that Royal Mail will not be obliged in any circumstances to provide Suppression Data or related services directly to the End User

 

  1. ROYAL MAIL'S IPR NOTICE
    5.1. The End User acknowledges that Royal Mail is the owner of the Intellectual Property Rights in the Suppression Data and the associated brands (as relevant) and it does not acquire and is not granted any rights to use those Intellectual Property Rights other than as set out in this Agreement and in these terms.

 

  1. CESSATION OF USE
    6.1. The End User must cease use of the Supplier Data if their right to use it is terminated and the End User and any Authorised Users or subcontractor authorised under these Additional Terms to use the Supplier Data must also destroy any copies of Supplier Data they hold.
