The Supplier Data used to provide the Dataset is supplied by GBG’s Supplier, NationalMap Limited. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licensing provisions. Datasets can be identified by the ID Number listed on the End User’s Order Form.

Unless otherwise stated, definitions used in these Additional Terms have the same meaning as those definitions are used in the Agreement between GBG and the Customer for the provision of the Dataset. 

1. Permitted Use 

The Customer may use the Dataset and any Results derived from it solely for its lawful internal business purposes and for the Permitted Purpose specified in the applicable Order Form. 

The Customer must not, without GBG's prior written consent: 

• copy, reproduce, modify, create derivative works from, distribute, publish, disclose, sell, resell, sublicense or otherwise make available the Dataset to any third party; or 

• use the Dataset other than as incorporated into, and accessed through, the relevant Service, 

except to the extent expressly permitted by applicable law. 

2. Intellectual Property Rights

All Intellectual Property Rights in the Dataset, including any updates, enhancements and modifications, remain vested in the relevant Supplier and its licensors. 

The Customer acquires no ownership rights in the Dataset and receives only the limited rights expressly granted under the Agreement. 

3. Copyright Notices and Attribution

The Customer must not remove, obscure or alter any copyright notice, proprietary legend, attribution statement or other notice relating to the Dataset. 

The Customer must ensure that any such notices made available through the Service are preserved at all times. 

4. Record Keeping and Audit Assistance

The Customer must maintain complete and accurate records relating to its use of the Dataset. 

Upon reasonable request from GBG or the Supplier, the Customer must provide information reasonably required by GBG to demonstrate the Customer's compliance with these Additional Terms and to enable GBG to comply with its obligations to the Supplier. 

5. Changes to Dataset

The Customer acknowledges and agrees that: 

• the Dataset; 

• the content, coverage and functionality of the Dataset; and 

• any Charges applicable to the Dataset, 

may be amended, updated, substituted or withdrawn from time to time. 

6. No Warranties

To the maximum extent permitted by law, the Dataset is provided on an "as is" and "as available" basis. 

GBG and the Supplier do not warrant that the Dataset will be accurate, complete, current, error-free or uninterrupted. 

7. Feedback

Any feedback, suggestions, recommendations or comments provided by the Customer relating to the Dataset may be used by GBG, thevSupplier and their respective licensors without restriction and without payment or obligation to the Customer. 

8. Third Party Claims

If the Customer receives any claim, demand, notice or allegation that the Dataset infringes the rights of a third party, the Customer must promptly notify GBG and provide all relevant details. 

GBG and/or the Supplier may elect to manage, defend, settle or otherwise respond to such claim. 

9. Suspension and Termination

Without limiting any other rights under the Agreement, GBG may immediately suspend or terminate the Customer's access to the Dataset if the Customer breaches these Additional Terms or otherwise uses the Dataset in an unauthorised manner. 

10. Exclusion of Supplier Liability

The Supplier, its licensors and related parties have no liability to the Customer in connection with the Dataset, whether in contract, tort (including negligence), statute or otherwise. 

11. Third Party Beneficiary

The Supplier and its licensors are intended beneficiaries of these Additional Terms and may enforce the provisions of these Additional Terms directly against the Customer to the extent necessary to protect their rights in the Dataset.
