The Supplier Data used to provide the Dataset is provided by GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all Customers agree to comply with the following licencing provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the Agreement:
“Permitted Purpose” means the purposes, restrictions and or conditions for use of the Dataset outlined by the Supplier as set out in these Additional Terms below in addition to the restrictions set out in the Agreement.

2. USE OF THE DATASET
2.1. The Customer shall not request, obtain or use any Services subject to the Gramm-Leach-Bliley Act (GLBA) for any purpose other than for which it is requested. The Customer certifies it will use such Services subject to GLBA solely for one or more of the following permitted uses as described below, and as may be interpreted from time to time, by competent legislative, regulatory or judicial authority, and encompassed by the GLBA:
• As necessary to effect, administer, or enforce a transaction requested or authorized by the consumer, or in connection with servicing or processing a financial product or service requested or authorized by a consumer;
• As necessary to effect, administer, or enforce a transaction requested or authorized by a consumer, or in connection with maintaining or servicing the consumer’s account with the Customer and the Customer is a financial institution;
• With the consent or at the direction of a consumer;
• To protect the confidentiality or security of the Customer’s records pertaining to a consumer, the service or product, or the transaction therein and the Customer is a financial institution;
• To protect against or prevent actual or potential fraud, unauthorized transactions, claims, or other liability;
• For required institutional risk control or for resolving consumer disputes or inquiries;
• For use solely in conjunction with a legal or beneficial interest held by the Customer and relating to a consumer;
• For use solely in the Customer’s fiduciary or representative capacity on behalf of a consumer;
• To comply with federal, state, or local laws, rules and other applicable legal requirements.

2.2. The Customer shall not: (i) use the Dataset more than one time, or for a purpose other than which it was obtained; (ii) after the one-time use, create, maintain and/or use derivative databases, works or services using the Dataset, or information obtained or derived therefrom; (iii) use the Dataset in any way that may infringe any copyright or other proprietary interests of the Supplier or any third party; (iv) use the Dataset in any way that may violate rights of publicity or privacy of any individual whose personally identifiable data are retrieved; (v) use the Dataset for FCRA (Fair Credit Reporting Act) purposes including, but not limited to, (A) eligibility for credit, insurance or employment, (B) in connection with the underwriting of insurance, or (C) in connection with the determination of an individual’s eligibility for a license or other benefit granted by a governmental instrumentality; (vi) in connection with any sweepstakes, contest game, or similar promotional devices; (vii) in connection with pornographic product or service or other product or service which caters to prurient interests; (viii) in connection with criminal investigations or other law enforcement purposes; or (vii) interfere with or present in any way a material security risk or interruption in the operation of the Dataset.
2.3. The Customer agrees to and certifies compliance with the following:
(1) The Customer holds the Dataset in confidence, using no less than a reasonable degree of care, and shall not disclose the Dataset to any third party;
(2) The Customer shall not disassemble, decompile, or in any way reverse engineer the Dataset;
(3) The Customer discloses the Dataset only to its designated and authorized employees having a need to know and only to the extent necessary to enable the Customer to use the Dataset in accordance with the Agreement. The Customer ensures that such designated and authorized employees shall not attempt to obtain any data on themselves, associates, or any other person, except in the exercise of their official duties;
(4) The Customer implements, and shall take all measures to maintain, commercially reasonable and appropriate administrative, technical and physical, security safeguards (“Safeguards”) designed to (a) ensure the security and confidentiality of the Dataset; (b) protect against any and all reasonably anticipated threats or hazards to the security or integrity of such Dataset; and (c) protect against unauthorized access or use of such Dataset that could result in substantial harm or inconvenience to any consumer;
(5) The Customer does not request, obtain or use the Dataset in a way that (a) may violate rights of publicity or privacy of any individual whose personally identifiable data are retrieved; (b) may violate applicable laws or governmental regulations, including, without limitation, Do Not Call legislation, consumer protection, securities, child pornography, obscenity, data privacy, data transfer and communications laws, export laws, or any other international, federal, state or local laws or regulations;
(6) The Customer does not take any adverse action, which is based in whole or in part on the Dataset, against any consumer. The terms “adverse action” and “consumer” shall have the same respective meaning as those terms are defined in the FCRA; and
(7) The Customer is prohibited from further reselling or licensing the Dataset to other third parties.
2.4. The Customer shall comply with all federal, state and local laws, statutes, regulations and rules applicable to it including, without limitation, the GLBA, and all reasonable procedures prescribed by GBG. The Customer certifies it is a legitimate business, and it has permitted use for obtaining the Dataset when applicable.

2.5 The Customer shall not use the Dataset to advertise, sell, or exchange any products or services that involve sexual paraphernalia, drug paraphernalia, adult films, recordings or magazines weapons, credit repair services or other illegal activities.
2.6. The Customer warrants that it will not use this Dataset for any reason outside of the Permitted Purpose.
