1. Definitions
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the Agreement:
“AI” means a machine-based system that is designed to operate with varying levels of autonomy and that may exhibit adaptiveness after deployment, and that, for explicit or implicit objectives, infers from the input it receives how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical and virtual environments.
“AI Regulations” means the EU AI Act (Regulation (EU) 2024/1689) and any amendment, consolidation or re-enactment thereof, any legislation of equivalent purpose or effect enacted, and any orders, guidelines, guidance and instructions issued under the above relevant authority.
“AI Support Tools” means upstream artificial intelligence technologies (including large language models and similar systems) used by GBG solely to support the generation of Insights.
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any Personal Data.
“Insights” means data that is created by GBG as part of the provision of the Service, from the collection, storage and analysis of information about the End User’s use of the Service (including the End User Data), and the outcome/result generated as a result of transactions undertaken by the End User.
“Proprietary AI Models” means any artificial intelligence or machine learning model developed, trained, and owned by GBG, used within the Service to analyse End User Data or generate Insights, and operated exclusively under GBG’s controls and governance framework.

2. USE OF THE SERVICE
2.1. The End User acknowledges and accepts that it may only use the Service where it has elected to opt in to GBG Data Network (dataset ID 201493) and such opt‑in remains valid and in effect at all times. If the End User opts out of the GBG Data Network, the End User’s right to use the Service will automatically and immediately terminate without liability or any further action by GBG.
2.2. Depending on the features available in the Datasets selected by the End User on the Order Form, the Service may generate Insights in one or more of the following ways:
a) Foresight Standard: Anonymised End User Data, with the assistance of Proprietary AI Models and AI Support Tools.
b) Foresight Enhanced: End User Data, including Personal Data, using deterministic, logic-based algorithms with no artificial intelligence or machine‑learning components.
c) Foresight Premium: End User Data, including Personal Data, using with the assistance of Proprietary AI Models and AI Support Tools.
2.3. The End User acknowledges and accepts that certain Insights generated by the Service may be AI assisted. The AI functionality within the Service is classified as “limited risk” under applicable AI Regulations. The End User does not incur any additional AI compliance duties when using the Service, and all AI assisted Insights remain subject to clear human interpretability and oversight.
2.4. The End User acknowledges that GBG will apply anonymisation measures, so that the End User Data processed by AI Support Tools will not be reasonably likely to identify any individual.
2.5. The End User acknowledges that GBG maintains robust safeguards, monitoring, and controls to ensure the safe and reliable operation of all AI components, including any AI Support Tools, solely to support summarisation or contextual interpretation.
2.6. GBG confirms that the End User Data is not retained, not re-used, and not used to train or improve any upstream AI Support Tools. The Personal Data within the End User Data is not used to train Proprietary AI models unless the End User provides explicit consent to GBG.
2.7. The End User acknowledges and accepts that this Foresight Dataset delivers non-decisional insights (e.g., dashboards, summaries, recommendations) and is not designed or intended to be used as the sole basis for making decisions producing legal or similarly significant effects on individuals. GBG makes no guarantee that Insights will resolve any data quality issues or achieve specific match-rate improvements.
2.8. The End User must not: (a) use Insights as a standalone decisioning tool; or (b) resell, distribute, or disclose Insights outside its organisation, unless otherwise agreed by GBG.
2.9. The End User acknowledges that the Service does not contain Personal Data pertaining to the United States of America or any of its territories.

3. INTELLECTUAL PROPERTY
3.1. All Intellectual Property Rights in and to any Insights created by GBG belong and shall continue to belong to GBG.
3.2. The End User receives only a non-exclusive, non-transferable, revokable licence to use Insights during the term of the Agreement, subject to the restrictions outlined in these Additional Terms.
