State of Victoria
1. Definitions


Agreement means the agreement with GBG under which GBG provides the End User identity verification services.

Attributions means any attributions, copyright or disclaimers to be included on the Information Products.

Authorised Purpose means the End User’s own internal use for the purposes of conducting electronic identity verification checks.


Information Product means the Ownership Verification Check product provided by the Registry Operator which involves a comparison between data attributes provided by the End User and information maintained by the Registry Operator. 


Intellectual Property Rights means all intellectual or industrial property rights, including without limitation, a patent, invention, copyright, trademark, design, trade secrets, rights in confidential information, circuit layout designs and rights in relation to circuit rights, in each case whether or not registered or registrable. In the case of the Registry Operator, Intellectual Property Rights also includes all intellectual property rights in the Information Products and the Registry Operator Marks and any information or documentation printed or displayed on, or incorporated in, the Information Products (including the Marketing Collateral) provided by the Registry Operator under this Agreement or included in the Register from time to time, including all derivations, adaptions, modifications and enhancements to such items.
Marketing Materials means the registered and unregistered trademarks that the Registry Operator and/or State owns or licences from time to time.


Registry Operator means Secure Electronic Registries Victoria Pty Ltd (ABN 86 628 986 396) as trustee for Secure Electronic Registries Victoria Trust (ABN 83 206 746 897).
Registry Operator Data means all data and information:
a. relating to the Registry Operator and/or the State and their respective operations, facilities, customers, clients, personnel, assets and programs in whatever form that information may exist, which is provided to or otherwise accessed by GBG; s supplier, GBG or the End User in connection with the Agreement; or
b. which is entered into, stored in, generated by, or processed as part of the Information Product order or the creation of an Information Product,
and includes the data or information incorporated in any Information Product, Registry Operator’s Confidential Information, Registry Operator’s Intellectual Property and the Registry Operator Marks.
Registry Operator Marks means Marketing Materials and Attributions.
State the State of Victoria including the Department of Transport and Planning, Land Use Victoria and the Registrar of Titles in Victoria.


2. Terms of Use
a. The End User acknowledges and agrees that all Intellectual Property Rights in the Information Products are owned by or will upon creation vest in the Registry Operator, the State, and/or their licensors, and nothing in this Agreement results in the transfer of any rights, title, or interest in such Intellectual Property Rights.
b. For any complaints relating to the Service, End User may contact GBG using the contact details set out below and in doing so, the End User may request that the Registry Operator participate in the dispute resolution process: Customer.Support@gbg.com
c. The End User acknowledge and agree that the Information Products and/or Registry Operator Data must only be used in accordance with the Authorised Purpose.

State of Western Australia
1. Definitions
Agreement means the agreement with GBG under which GBG provides the End User identity verification services.
Data means the “match” or “no match” output that is provided by the Supplier in response to an identity verification enquiry.
Landgate means the Western Australian Land Information Authority, a body corporate established by the Land Information Authority Act 2006 and trading as Landgate.
Supplier means Land Services WA Operating Pty Limited as trustee for the Land Services WA Operating Trust (ACN 635 080 232)


2. Terms of Use
a. Use of Data Validation and Enrichment Service
The End User (and End User’s employees, contractors and agents) must only use the Data for the End User’s personal or internal administration and operation.
b. Third Party Use
Other than where expressly authorised above, the End User (and End User’s employees, contractors and agents) must not reproduce, sell, on-sell, hire, let, trade, sub-licence, distribute, disclose or otherwise provide the Data in any form to any other person.
c. No reliance: The End User acknowledge and agree that:
• the Data may be invalid if an individual’s identity is suppressed or the person has no dealings recorded in the register;
• The End User should not act on the basis of the Data without first obtaining specific professional advice;
• it is the End User’s sole responsibility to ensure that the Data meets its own individual requirements;
• the Data is not warranted by Landgate;
• any reliance on the Data is at the End User’s own risk; and
• neither Landgate nor the Supplier is responsible for any reliance by the End User on the Data.
