The Supplier Data used to provide Australia Geo S59 Dataset is obtained from GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following provisions:

1. USE OF THE DATASET

1.1. The End User shall not use the Supplier Data for the generation of an address or a compilation of addresses for the sending of mail unless the End User has verified that each address to be used for the sending of mail is capable of receiving mail by reference to a secondary source of information other than the Supplier Data.

2. EXCLUSION OF WARRANTIES AND LIABILITY

2.1. The Supplier Data are provided on an “as is” and “as-available” basis. No statement, representation, or warranty of any kind (whether express, implied, statutory or other) is given in relation to the Supplier Data (including without limitation any warranties of title, merchantability, fitness for a particular purpose, non-infringement, absence of latent or other defects, accuracy, or the presence or absence of errors, whether or not known or discoverable). 

2.2. In no event will GBG and the Supplier be liable to the End User on any legal theory (including, without limitation, negligence) or otherwise for any direct, special, indirect, incidental, consequential, punitive, exemplary, or other losses, costs, expenses, or damages arising out of the use of the Supplier Data and/or Dataset, even if the End User has been advised of the possibility of such losses, costs, expenses, or damages.

The End User acknowledges and accepts the Supplier Data contained in this Dataset is subject to some open source licences. The End User must comply with those open source licences mentionedhere (as amended from time to time).
