The Supplier Data used to provide the AU Govt ID Source is provided by GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licencing provisions.

1. DEFINITIONS AND INTERPRETATION 

1.1. “DVS” has the meaning given to the term “DVS” in section 15 of the IVS Act
1.2. “Information Match Agent” means a person appointed as an agent to act for the End User and on the End User’s behalf solely for the purposes of the End User’s use of the DVS, including the:
(a) making of an Information Match Request; and
(b) receiving of an Information Match Result.
1.3. “Information Match Request” means an electronic request to the DVS by the End User (required to be submitted in a structure electronic format advised by the Framework Administrator) to be provided with an Information Match Result in relation to the details of relevant information in a Supported Document.
1.4. “Information Match Result” means, in respect to an Information Match Request, an electronic response indicating that the information provided in the request either matches or does not match the relevant official record data, or that a system error has been encountered in trying to process that request.
1.5. “IVS Act” means the Identity Verification Services Act 2023 (Cth).
1.6. “Framework Administrator” means the Commonwealth of Australia acting and represented by the Attorney-General’s Department and, also includes, in respect of each type of document supported by the DVS, the applicable entity whose official record data is matched against that document and (in the case of Australian State and Territory), Austroads Ltd and the relevant Registry of Births, Deaths and Marriages (BDMs).
1.7. “Participation Agreement” means the agreement entered into by the End User and the Commonwealth of Australia, relating to the End User’s access to and use of the DVS.
1.8. “Supported Document” means a type of document set out in the definition of ‘DVS document’ in section 5 of the IVS Act.

 

2. USE OF THE SOURCE/DATASET
1.1. By taking this Source/Dataset, the End User agrees to the DVS Business User Participation Agreement, the DVS Identity Supplier Provider Participation Agreement, and any terms as may be specified by the Supplier of the Document Verification Service (“DVS Terms”).
1.2. The DVS Terms are set by the Framework Administrators. The DVS Terms can be provided to the End User upon the End User’s written request, subject to any restrictions and requirements as may be imposed by Framework Administrator  Please visit https://www.idmatch.gov.au/resources for more information. 
1.3. The End User agrees that disclaimers, exclusions, limitations of liability and indemnities that form part of the Agreement are for our benefit and for the benefit of the Framework Administrator, and can be enforced by us on behalf of the Framework Administrator or directly by the Framework Administrator
1.4. Use of the DVS is provided subject to the End User ensuring that:
(a) Any necessary consent required to use the DVS Services (in written or electronic form) from a verification subject is obtained and provided by the verification subject before any identity checking or use of the DVS Services is performed; and
(b) The End User shall retain evidence of such consent and provide any consents to GBG within five (5) business days of a request from GBG;
1.5. GBG may, at its absolute discretion, provide an End User with specific consent wording that is required in order for the End User to have access to a certain data source. Access may be withheld until such time that evidence is provided of the relevant consent wording being in place.
1.6. Where DVS services are purchased, the End User warrants that they have complied with these Additional Terms, and that the End User must provide evidence in relation to adherence to DVS consent requirements being incorporated into their consent notice, prior to access being granted to the DVS service. 

3. Appointment as an Information Match Agent
3.1. The End User appoints GBG ANZ Pty Ltd as an Information Match Agent.
3.2. The End User may revoke GBG ANZ Pty Ltd appointment as an Information Match Agent at any time.
3.3. Any appointment of GBG ANZ Pty Ltd as an Information Match Agent will be automatically revoked at the expiration or termination of the Agreement.

4. Identity Service Provider
4.1. This clause 4 only applies if the End User is an Identity Service Provider (IDSP) of the DVS. Unless otherwise expressly provided, defined terms used in this clause 4 have the same meaning as those terms are defined under the IDSP Participation Agreement with DVS.
4.2. The End User will:
4.2.1. provide details of all its DVS Service Clients (this applies to any new DVS Service Client);
4.2.2. ensure all DVS Service Clients meets the usage requirements of the DVS and provide relevant information to evidence the manner in which the End User concluded the DVS Service Client meets such usage requirements prior to allowing the DVS Service Client to submit any transactions;
4.2.3. ensure all DVS Service Clients will comply with these Additional Terms and the the End User's IDSP Participation Agreement as applicable;
4.2.4. maintain appropriate records of all DVS Service Clients including records of transactions created and submitted and IP addresses and submit monthly reports to GBG outlining these details;
4.2.5. upon GBG's request, within 1 business day (or such other reasonable time as we may specify), provide GBG with the requested information in relation to the End User's DVS Service Clients and the use of the Services;
4.2.6. provide GBG with reasonable assistance and information GBG may require for GBG to meet our regulatory obligations; and
4.2.7. provide support and maintenance services to your DVS Service Clients.
4.2.8. Audits. The End User understands that GBG is required by the Framework Administrator to conduct audits on the ID Service Providers. As such, the End User agrees that GBG is entitled to conduct an on-site and/or inspection or to appoint a third-party auditor, subject to GBG and/or our third-party auditor’s agreement to reasonable and appropriate confidentiality undertakings. The purpose of GBG's right to carry out an audit and/or inspection is to verify the End User's compliance with the DVS requirements, including but not limited to: onboarding and validation, recording of consent prior to submission of document for verification, disclosure of Information Match Results.
