• GBG hosts the Supplier Data
• No personal data is transferred to the Supplier

The Supplier Data that GBG uses to provide the Insolvency Dataset is obtained from a number of GBG’s Suppliers. GBG is obliged under the terms of its agreement with its Supplier (Northern Ireland Supplier)to ensure that all End Users agree to comply with the following licencing provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Permitted Purpose” means the purposes, restrictions and or conditions for use of the Dataset outlined by the Supplier in clauses 2.3 – 2.4 below in addition to the Customer User Case set out in the Agreement and clause 2.1

2. USE OF THIS DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed in this clause 2.1, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:
• Fraud
• Law Enforcement
• Debt Collection or Recovery
• Asset Reunification
• Evidence Gatherers (B2B/Private Sector)
• Affordability
• Media
2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the following terms set out in clauses 2.3-2.4 also apply.
2.3. The Supplier shall have the right to make any changes to the Supplier Data which are necessary to comply with any applicable law, or which do not materially affect the nature or quality of the Supplier Data. In the event of any changes, GBG shall notify the End User.
2.4. In addition, the Supplier may vary the content of the Supplier Data or the format of the Supplier Data at its discretion upon providing 4 months’ prior written notice.
2.5. The End User shall:
• Under no circumstances reproduce the Supplier Data, the Dataset or provide a similar service using the Supplier Data or information extracted from it or the Dataset;
• not use the Supplier Data or Dataset for the purposes of directing advertising or marketing materials to any legal or natural person by the End User or any of its clients or associated bodies corporate; and
• Either at GBG’s request, or immediately after the End User becomes aware, destroy all Supplier Data on its databases in relation to an individual as soon as either such data ceases to be accurate and up to date or it is no longer necessary to retain that data for legitimate business purposes. This obligation shall survive the expiry of the Agreement or termination of this Dataset.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1. GBG provides this Dataset in its capacity as an independent controller.
3.2. GBG does not transfer End User Data to the Supplier to provide this Dataset.

4. LIABILITY
4.1. Where the End User requests access to this Dataset, the End User acknowledges that GBG has been granted a limited licence to provide its customers with access to the Supplier Data and such access may be revoked or withdrawn at any time by the Supplier for which GBG cannot be held responsible.
4.2. In no event shall the Supplier be liable to the End User for any loss or damages arising from any interruption or cessation of the Supplier Data.
4.3. The Supplier hereby expressly excludes all liabilities in respect of inaccurate or incomplete information howsoever arising including (without limitation) those arising as a result of inaccuracies in the information provided to the Supplier.

5. TERMINATION
5.1. Notwithstanding the termination provisions between GBG and the End User in the Agreement, under the terms of GBG’s agreement with its Supplier, the Supplier is entitled to suspend or terminate access to the Supplier Data at any time for any reason.
5.2. Notwithstanding the termination provisions between GBG and the End User in the Agreement, the Supplier may terminate the supply of Supplier Data to GBG if it is obligated to comply with an order, instruction or request of government, emergency services organisation or other competent administrative authority.
5.3. Notwithstanding the termination provisions between GBG and the End User in the Agreement, the Supplier Data may be terminated upon one months notice.
