The Supplier Data that GBG uses to provide Email checks is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all End Users agree to comply with the following provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Applicable Regulations” means the Privacy and Data Protection Requirements, the DMA Guidelines, British Codes of Advertising and Sales Promotions together with any other applicable law, regulation or code.
“Consumer” means an individual who is a customer or potential customer of an End User.
“Permitted Purpose” means use the Supplier Data (i) to deliver or procure the delivery of email messages to Consumers, (ii) to append or update existing data records and/or (iii) for the purposes of receiving marketing, validation, verification or other services.

2. USE OF THE SERVICE
2.1 The End User shall ensure that the Supplier Data is used only for the Permitted Purpose
2.2 The End User must not disclose the Supplier Data to any third party except as contemplated by this Agreement, nor disclose it to any of its own officers, employees, agents or contractors except those who have a need to have it disclosed to them for the purpose of this Agreement.
2.3 Notwithstanding the above clause 2.2, the End User shall be permitted to pass the Supplier Data to their third party service providers provided that such third parties only process the Supplier Data for the benefit of the End User.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1 GBG hosts the Supplier Data.
3.2 GBG does not use Sub-processors to provide the End User with this element of the Service as the Supplier Data is hosted by GBG.
3.3 The End User shall at all times maintain all licences and registrations required by Applicable Regulations and shall comply with all Applicable Regulations (including as required for the processing, supply or use of Personal Data).

4. TERMINATION
4.1 Notwithstanding the length of the Initial Period of the Agreement agreed between GBG and the End User, under the terms of GBG’s agreement with its Data Supplier, the supply of Email checks are subject to a maximum licence term (or renewal term) of 12 months.
4.2 In the event that the Initial Period agreed between GBG and the End User exceeds 12 months, the initial licence term for the use of the Supplier Data shall be limited to 12 months but shall automatically renew for subsequent periods of no more than 12 months to cover the entire Initial Period and any subsequent Renewal Periods.
