• Data Supplier hosts the Supplier Data
• KYP Employment Check (UK & other countries) is provided directly by the Data Supplier
• Data Supplier receives and processes Client Information as a Processor
• Client Information contains Personal Data
• The Data Supplier is located in the United Kingdom
• The Data Supplier works with a number of Third Parties to provide the Supplier Data as part of the KYP Employment Check (UK & other countries). Full details are provided below.
• Where GDPR applies to the End User, the End User must rely on a derogation to transfer Client Information to a Third Party that may be based outside of the EEA in accordance with Article 49 GDPR

The Supplier Data that GBG uses to provide KYP Employment Check (UK & other countries) is supplied by GBG’s Data Supplier and its Third Parties. GBG is obliged under the terms of its agreement with to the Data Supplier to ensure that all End Users agree to comply with the following provisions:

1. DEFINITIONS
1.1. In these Additional Terms the following definitions shall apply in addition to the definitions set out in the General Terms:
“Third Parties” shall mean (a) any authorities in the relevant country or jurisdiction of the search; and or (b) the Applicant’s current or past educational institutions that will process the Client Information in their capacity as a Controller.

2. USE OF THE SERVICE
2.1. The End User’s request for KYP Employment Check (UK & other countries) will be deemed to be the End User’s instruction for GBG to direct the End User to the Data Supplier’s portal.
2.2. The End User acknowledges and accepts that use of the Supplier Data is subject to the Data Supplier’s standard terms and conditions and the End User warrants that it shall only access the Supplier Data in accordance with the Agreement, these Additional Terms and the Data Supplier’s terms. 2.3. The End User shall be provided access to the Supplier Data by GBG for the purposes of verifying an individual’s qualifications only.
2.4. The End User acknowledges and accepts that the Data Supplier shall engage directly with Third Parties listed by an Applicant and this may be outside of the United Kingdom and the EEA.
2.5. The End User shall, where completing the information on behalf of an Applicant, obtain the permission from the Applicant to release the relevant information of the Applicant before requesting access to the Supplier Data associated with that Applicant.
2.6. The End User shall, where completing the information on behalf of an Applicant and where relevant, notify and obtain the consent from the Applicant, that their Personal Data may be transferred outside of the EEA if relevant and required.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1. The Supplier Data used to provide you with this element of the Service is hosted by the Data Supplier in the United Kingdom. In order to perform the Services, the Data Supplier shall act as Processor of the Client Information (including any Personal Data supplied) for the sole purpose of delivering this element of the Service. The Client authorises GBG to appoint the Data Supplier as Processor for the purposes specified in this clause 3.1
3.2. Where the Data Supplier is required to engage with a Third Party outside of the EEA, and where GDPR applies to the End User, the End User acknowledges that prior to submitting Client Information to the Data Supplier for processing it shall determine, and is solely liable for ensuring that it can rely on a derogation to transfer Client Information to the controller based outside of the EEA in accordance with Article 49 GDPR.
