• GBG hosts the Supplier Data
• No personal data is transferred to the Supplier

The Supplier Data that GBG uses to provide the National Register of Social Housing is obtained from GBG’s Supplier, Homes England. The Supplier has published the Supplier Data in accordance with its open source licence terms. GBG is obliged under the terms of the open source licence provided by its Supplier to ensure that all End Users agree to comply with the following licencing provisions:

1. DEFINITIONS
1.1. In these Additional Terms the following definitions shall apply in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
Permitted Purpose” means the purposes, restrictions and or conditions for use of the Dataset outlined by the Supplier at clause 2.3-2.7 below in additional to the Customer Use Case set out in the Agreement and at clause 2.1.

2. USE OF THIS DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out the Agreement or these Additional Terms:
• Fraud
• Law Enforcement
• Debt Collection or Recovery
• Asset Reunification
• Evidence Gatherers (B2B/Private Sector)
• Affordability
• Media
2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the following terms set out in clauses 2.3-2.8 also apply
2.3. The Supplier Data contains public sector information licensed under the Open Government Licence v3.0 (http://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/) which is incorporated into these Additional Terms.
2.4. Where an End User is explicitly permitted in its Agreement with GBG to publish or otherwise share the Supplier Data with any other third party (for example as an authorised reseller or channel partner), the End User must ensure that all additional End Users who receive or access the Supplier Data receive a copy of these Additional Terms and associated copyright notices.
2.5. In the event of a breach of these Additional Terms by an End User the rights granted to the End User under this licence, or any similar licence will end automatically.
2.6. The Supplier Data is taken from the National Register for Social Housing and includes information on social housing properties in England, with a range of details captured on each property.
2.7. The End User agrees to not to use the Supplier Data in a way that suggests any official status or in a way that suggests that the Supplier endorses the End User or its use of the Supplier Data.
2.8. The End User warrants that it will not use the Dataset for any reason outside of the Customer Use Case and Permitted Purpose.


3. EXCLUSION OF WARRANTIES
3.1 The End User acknowledges and accepts that the records contained within the Supplier Data are submitted by social landlords. Due to the nature of the collection of the Supplier Data, some information may be out of date and of varying quantity and quality with many incomplete, inaccurate or missing records. The database of Supplier Data may also contain a number of duplicate entries.
3.2 The Supplier and GBG are not liable for any errors or omissions in the Supplier Data and shall not be liable for any loss, injury or damage of any kind caused by its use.
3.3 The Supplier and GBG cannot guarantee the continued supply of the Supplier Data.


4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1 GBG provides this Dataset in its capacity as an independent controller.
4.2 GBG does not transfer End User Data to the Supplier to provide this Dataset.
