• The Supplier hosts the Supplier Data
• The Supplier is a processor of End User Data appointed by GBG in its capacity as an independent controller
• End User Data includes personal data
• The Supplier is located in the EEA
• The EEA is deemed to offer an adequate level of data protection by the United Kingdom

The Supplier Data that GBG uses to provide Mobile Validation is obtained from GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licencing provisions:

1. DEFINITIONS
1.1 In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms 
End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
Permitted Purpose” means the purposes, restrictions and or conditions for use of the Dataset outlined by the Supplier in clause 2.2 in addition to the Customer User Case set out in the Agreement and clause 2.1.

2. USE OF THIS DATASET
GBG is under licence to provide Mobile Validation S2 checks to the End User, the End User acknowledges and accepts that:
2.1 The Supplier Data may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:
• Fraud
• Law Enforcement
• Debt Collection or Recovery
• Asset Reunification
• Evidence Gatherers (B2B/Private Sector)
• Affordability
• Media
2.2 In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the End User will not:
(a) do or cause to be done anything that violates the requirements of any network operator as a result of use of the Dataset;
(b) Transmit or allow to be transmitted any information, data or messages sent to recipients as a result of the use of the Dataset that are false, inaccurate, misleading, unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
(c) Transmit or allow to be transmitted any information, data or messages sent to recipients as a result of the use of the Dataset that harms minors in any way;
(d) Transmit or allow to be transmitted any information, data or messages sent to recipients as a result of the use of the Dataset that it does not have a right to make available under any law or under contractual or fiduciary relationships;
(e) Transmit or allow to be transmitted any information, data or messages sent to recipients as a result of the use of the Dataset that infringe any patent, trademark, trade secret, copyright, or other proprietary rights or rights of publicity or privacy of any party;
(f) Utilise any unsolicited or unauthorised advertising, promotional materials, “junk mail", "spam”, or any other forms of unauthorised solicitation;
(g) Violate the standards of practice set forth by the Mobile Marketing Association;
(h) Transmit or utilise any (i) viruses, worms, trojan horses, or other code that might disrupt, disable, harm, erase memory, or otherwise impede the operation, features, or functionality of any software, firmware, hardware, wireless device, computer system or network, (ii) traps, time bombs, or other code that would disable any software based on the elapsing of a period of time, advancement to a particular date or other numeral, (iii) code that would permit any third party to interfere with or surreptitiously access any personal information, or (iv) content that causes disablement or impairment of the Supplier’s or any network operator’s service or equipment;
(i) Intentionally or unintentionally violate any applicable local, state, national or international law, or any regulations having the force of law;
(j) Collect or store personal data in connection with the prohibited conduct and activities set forth hereinabove.
2.3 The End User warrants that it will not use the Dataset for any reason outside the Customer Use Case and Permitted Purpose.

3. EXCLUSION OF WARRANTIES
3.1 The End User acknowledges and agrees that the data is provided “as is”, “as available” and with all faults and is provided without any covenants, promises or guarantees as to accuracy, functionality, performance, merchantability, system integration, data accuracy or fitness for any purpose. Any conditions, terms or warranties as to the same implied or imposed by statue or common law are hereby excluded to the fullest extent permitted by law.

4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1 The Supplier Data used to provide the Dataset is hosted by the Supplier in the EEA. In order to perform the Services, the Supplier shall receive and process End User Data as a processor appointed by GBG in its capacity as an independent controller for the sole purpose of delivering this Dataset.
4.2 The EEA is deemed to offer an adequate level of data protection for personal data by the United Kingdom, therefore End User Data can be safely transferred to the Supplier without further data export safeguards.
